In the middle of August 2024, the Parliament of the Republic of Bulgaria submitted a bill on the requirements for accessibility of products and services (BRAPS). The bill also complies with Directive (EU) 2019/882 of the European Parliament and of the Council as of April 17, 2019, which regulates the requirements for accessibility of products and services in the European Union (EU).
The main motive for drafting the bill is the need to harmonize Bulgarian legislation with European accessibility standards. Currently, there are differences in the requirements for accessibility of products and services both within Bulgaria and between EU member states. This creates obstacles for the free movement of goods and services and makes it difficult for people with disabilities to access them.
Another important reason for the proposal of BRAPS is Bulgaria's commitment to the UN Convention on the Rights of Persons with Disabilities. The Convention requires States Parties to ensure equal opportunities and non-discrimination for persons with disabilities. The introduction of new requirements for accessibility will contribute to the fulfillment of these commitments and will improve the quality of life of people with disabilities in Bulgaria.
The bill covers a wide range of products and services, including electronic devices, means of transport, banking services, e-books and online commerce. The aim is to ensure that all these products and services are accessible to people with disabilities. In this regard, BRAPS imposes specific requirements on manufacturers and suppliers of products and services. They must ensure that their products and services are designed and manufactured in a way that makes them accessible to people with disabilities. This includes the use of appropriate technology and design that facilitate access. The bill includes detailed technical requirements for various categories of products and services. For example, electronic devices are required to have text magnification, voice control, and haptic feedback features.
Products and services should include, for example, the use of contrasting colors, easy-to-understand icons and intuitive interfaces. Manufacturers and suppliers are obliged to provide clear and accessible instructions for the use of products and services. Information should be available in a variety of formats, including audio and braille.
The bill provides for the creation of specialized authorities that will be responsible for monitoring and controlling compliance with accessibility requirements. These authorities will have the power to carry out inspections and impose sanctions for violations. In case of non-compliance with accessibility requirements, the law provides for the imposition of administrative sanctions and fines.
According to the transitional provisions of BRAPS, manufacturers and suppliers are given time to adapt their products and services to the new requirements. This will ensure a smooth transition and minimize possible difficulties.
